1. Parties
    This Passenger Transport and Service Agreement (Agreement) is arranged between “Disobey
    Travel Agency” located at Cevizli Mah. Zuhal Cad. Ritim Istanbul No:44 BH Maltepe / Istanbul
    (hereinafter referred to as “Disobey Travel Agency”) and the passengers who made
    reservations on www.viptransfer.com and/or on whose behalf reservations were made
    (hereinafter referred to as “Passenger”).
    In this Agreement, unless otherwise stated, “Disobey Travel Agency” and the Passenger will be
    referred to separately as “Party” and collectively as “Parties.”
  2. Subject
    With this Agreement, the Parties agree on the terms of the provision of airport transfer services
    within the borders of Turkey, for passengers before and after flights in the direction of airportaddress or address-airport with the designated vehicles, and the collection of the designated
    fee for this service by “Disobey Travel Agency.”
  3. Service and Payment Information
    3.1. The contract price includes VAT as specified in the service details.
    3.2. I agree that any fee for the transfer service I have received and/or will receive with this
    Agreement will be collected by Disobey Travel Agency with the credit card I will enter on the
    IYZICO screen and I authorize Disobey Travel Agency to charge the credit card.
    3.3. The invoice issuance period for the purchased service is 7 days from the purchase date,
    provided it does not exceed a calendar month, in accordance with the Tax Procedure Law.
    Payment Method: Bank Card or Credit Card.
  4. General Provisions
    4.1 The Passenger is obliged to act in accordance with all legislation, especially the Highway
    Traffic Law, and must comply with all rules within the framework of the legislation, such as
    wearing a seat belt and adhering to safety rules inside the vehicle.
    4.2 If the Passenger pays for the transfer service with a credit card or bank card, they are
    deemed to have accepted the written terms of the user service agreement even if they have not
    signed it.
    4.3 To benefit from the transfer service subject to this Agreement, the Passenger must make a
    reservation at least 2 hours before the transfer time. During religious and national holidays,
    New Year’s, and other official holidays, reservations must be made at least 24 hours in
    advance. The reservation can be canceled by the Passenger up to 24 hours before the transfer
    time. In this case, the service fee will be refunded to the Passenger. Cancellations made
    outside the specified periods will not be refunded.
    4.4 Passengers do not have the right to change the route in any transfer service. Requests for
    visiting a different location between the specified routes or waiting at a location for a certain
    time are not accepted. In VIP transfer service, requests for different points outside the route(s)
    specified in the agreement will be charged for each different point.
    4.5 Disobey Travel Agency is obliged to allocate a vehicle suitable for the number of
    passengers and baggage volume specified by the passenger at the time of purchase. Disobey
    Travel Agency guarantees that all vehicles assigned for the service subject to this Agreement
    will have complete individual accident and seat insurance, periodic maintenance will be carried
    out on time, and required items such as a spare tire, first aid kit, fire extinguisher, and reflector
    will be available in the vehicle. Disobey Travel Agency is not responsible for any bodily or
    material damage to the passenger or damage to transported items due to any traffic accident or
    other reasons during the transfer. The passenger irrevocably accepts and declares that
    Disobey Travel Agency will not have any liability arising from Article 66 of the Code of
    Obligations and other provisions of the legislation.
    4.6 Except for the number of passengers and baggage information provided by the Passenger
    at the time of purchase, any passengers or baggage exceeding the accepted limits by Disobey
    Travel Agency will not be accepted into the vehicle. If the Passenger gives up the transfer
    service for this reason, no refund will be made.
    4.7 If necessary, the passenger must prove to the vehicle personnel conducting the transfer
    that they are the customer who purchased the service with legal identification documents and
    the reservation document. If this obligation is not fulfilled, the transfer will not be carried out.
    However, if Disobey Travel Agency is convinced that the reservation holder’s credit card owner
    consents to the Passenger receiving this service, the Passenger may be allowed to use the
    service.
    4.8 Disobey Travel Agency is not responsible for the loss or damage of any items forgotten in
    the vehicle by the passenger during the transfer. The passenger must contact the Disobey
    Travel Agency call center immediately on the day they realize the item is forgotten. If the
    forgotten item is found, the passenger is responsible for collecting it from the notified address.
    Upon request, the forgotten item can be delivered to the passenger’s specified address for a
    fee.
    4.9 Disobey Travel Agency does not accept bags such as sacks, chests, and boxes as
    baggage in transfer vehicles. The baggage allowance is one carry-on bag and one suitcase per
    person (the carry-on bag should not exceed 8 kg, and the suitcase should not exceed 32 kg).
    The passenger agrees, declares, and undertakes that there are no flammable, explosive,
    narcotic, liquid, odorous, radioactive, and any items prohibited by Turkish legislation in the
    baggage subject to the transfer. If the driver notices any of the aforementioned items in the
    baggage, the baggage will not be accepted into the vehicle. In such cases, the passenger
    cannot claim any rights or receivables against Disobey Travel Agency. If the presence of these
    items is detected during a search by law enforcement during the transfer, the passenger will
    immediately compensate any damages and losses incurred by Disobey Travel Agency and/or
    any other person.
    4.10 Pet transfers in transfer vehicles are conducted in a secure cage that will not disturb other
    passengers and must be informed during the reservation. Only cats, dogs, and small songbirds
    are accepted as pets.
    The cage dimensions must be a maximum of 234055.
    4.11 Passenger Information
    4.11.1 Reservation information or preliminary information about the service received by the
    passenger will be shared via email and/or SMS. The passenger is responsible for the accuracy
    of the phone and email information provided. Disobey Travel Agency cannot be held
    responsible if the contact information is incorrect and notifications do not reach the Passenger.
    4.11.2 For shared transfers, the estimated pickup time will be shared with the passenger via
    email and/or SMS 12 hours before the transfer. For VIP services, the service will be provided
    according to the pickup and drop-off time specified by the passenger.
    4.12 In transfers from a certain point to the airport, Disobey Travel Agency guarantees that the
    vehicle allocated for the transfer will be at the specified point at the transfer time. Notification
    will be sent to the passenger via email and SMS before the scheduled transfer date and time. A
    delay of up to 20 minutes due to unexpected circumstances, such as traffic congestion, is
    considered acceptable. In case of delays exceeding 20 minutes due to reasons like site
    security not allowing the vehicle to enter, Disobey Travel Agency is not responsible. If the
    Passenger does not wait for the vehicle after the 20-minute delay, no refund will be made. The
    passenger must be ready at the transfer point with their baggage at the transfer time. If the
    passenger is not ready at the transfer point at the transfer time, the vehicle allocated by
    Disobey Travel Agency is obliged to wait for the passenger for 5 minutes. If the passenger does
    not reach the designated point with their baggage within 5 minutes, the vehicle is not obliged to
    wait further. The time notifications from Disobey Travel Agency’s operations, call center, and
    drivers are binding for the parties.
    4.13 In case of delays exceeding 2 hours due to delays or any other reason, Disobey Travel
    Agency is not obliged to keep the vehicle waiting at the airport. For shared transfers, the
    transfer will be made at a suitable time and with an available vehicle as determined by Disobey
    Travel Agency. For VIP services, a suitable vehicle will be allocated by Disobey Travel Agency
    to carry out the service.
    4.14. Agreements with partner companies and campaign conditions will apply. Disobey Travel
    Agency is responsible for ensuring that the vehicles reach the service locations at the time
    promised to the Passenger. If the allocated vehicle cannot go to the approved job due to an
    issue caused by Disobey Travel Agency, the service will be provided with a second vehicle
    without any additional charge to the Passenger. If the second vehicle also cannot reach the
    passenger address on time or if the Passenger cannot reach the flight time on time with the
    second vehicle, Disobey Travel Agency will cover all alternative transportation costs for the
    passenger to reach the airport. If the passenger has to use another mode of transportation
    (e.g., commercial taxi, public transportation, their own vehicle), the service will be provided
    again free of charge at the Passenger’s preferred time, or the service fee will be refunded to the
    credit card without any deductions (upon presenting a document). Disobey Travel Agency will
    only cover the transfer damage resulting from the Passenger missing their flight due to
    defective service. This compensation will not exceed 400 TL under any circumstances.
    4.15. The driver is not obliged to accompany the passenger to the vehicle or their home by
    leaving the vehicle at the transfer point.
    4.16. Transfers for children under 18 years of age will not be carried out without the presence
    of an adult companion or without parental permission.
    4.17. If the passenger requests a wheelchair transfer in shared transfers, this must be specified
    at the time of reservation. Otherwise, Disobey Travel Agency will not be responsible for any
    delay and/or inability of the passenger to board the vehicle. Physically disabled passengers
    who can meet their personal needs can travel alone without a companion. However,
    passengers who cannot meet their personal needs can be transferred with a companion. A
    reservation and
    fee must be made for the companion.
    4.18 If you purchase tickets online using a credit card that is not issued by Turkish banks, an
    additional processing fee may be charged by your bank to your ticket fee. For detailed information,
    you need to contact your bank.
    4.19 Passengers who do not have contagious diseases and who do not have any medical
    obstacles to travel are accepted for transfer with a doctor’s report stating “there is no obstacle for
    travel,” prepared no more than 20 days before the transfer.
    4.20 Due to operational reasons at airports, your vehicle will pick you up within a minimum of
    10 minutes and a maximum of 20 minutes. In cases of departure from an address, there is a 15-
    minute delay allowance.
    4.21 It is mandatory to wear seat belts inside the vehicles. Our company has the right to warn
    passengers who do not comply with this obligation by the vehicle driver and terminate the journey.
    Passengers who do not wear seat belts have pre-accepted that they will be responsible for all
    material and moral accident liabilities and damages to the interior of the vehicle during the journey.
    4.22 Cameras record inside the vehicles. These recordings are stored only in the vehicle and the
    main server. They cannot be shared with any third parties or at the request of the passenger. The
    retention period of the recordings is 9 full days. Passengers have pre-accepted that recordings are
    taken inside the vehicle.
    5. CANCELLATION – REFUND CONDITIONS
    5.1 If the times specified in this Agreement are exceeded and/or conditions are not met, the
    right to cancellation cannot be used, and Disobey Travel Agency will not make a refund.
    5.2 If you made the reservation through Disobey Travel Agency’s website, mobile application, or
    call center, you can make changes and cancellations via any of the online sales channels or the call
    center using the REF (Reference) Code and identification details.
    Disobey Travel Agency may unilaterally cancel the reservation and/or transfer due to unexpected
    situations, force majeure, natural disasters, hail, floods, traffic accidents, etc. In this case, if there is
    no fault attributable to it, no refund will be made.
    5.3 Passengers who request cancellation within less than 24 hours for shared transfers, less than
    24 hours for VIP transfers, or after the transfer time will be considered no-show passengers. In this
    case, no refund will be made.
    5.4 No cancellations, changes, or refunds will be made for the campaign product purchased by
    the passenger for any reason.
    Due to refunds of payments made by credit card, any financial damage, commission fees, etc.,
    incurred and to be incurred by Disobey Travel Agency by the Republic of Turkey or banks will be
    deducted from the amount to be refunded to the Passenger.
    5.5 Cancellations of reservations purchased in installments will be refunded in installments to
    the card account used for the payment.
    If the reservation is canceled by Disobey Travel Agency for any reason, the Passenger will be notified
    as soon as possible.
    5.6 If the Passenger does not comply with the obligations in this Agreement and/or if the
    reservation is canceled due to any fault and/or negligence of the Passenger and/or if the Passenger
    does not receive the service, Disobey Travel Agency will not have any responsibility. Therefore, all
    legal rights of Disobey Travel Agency are reserved, including the collection of the service fee.
    5.7 Disobey Travel Agency has the right to withhold transaction amounts in the event of
    Suspicious Transactions and if notified by the User or System Partner until the date of approval of the
    Payment Transaction. If the suspicion is confirmed with documentation, payments will not be
    processed definitively.
  • If there is a suspicion that the Payment Transaction is not in compliance with legal provisions,
  • If there is a suspicion that the Payment Transaction was made without the knowledge of the
    holder of the credit card used in the Payment Transaction,
  • If there is a suspicion that the Payment Transaction was made without the knowledge of the
    owner of the bank account used in the Payment Transaction,
  • If there is a suspicion that the Payment Transaction is not a real Payment Transaction (excluding
    tests).
    5.8 Refunds for transactions accepted by the bank after a cancellation/refund request will
    reflect on the Turkish bank credit card used for the transaction approximately 2-3 days after the endof-day report is received. For foreign credit cards, refunds will reflect in approximately 3-7 days,
    depending on the country. If the sales and refund transactions are carried out on the same day,
    automatic refunds are not accepted by the banks, so the refund will be made by Disobey Travel
    Agency on the next day (excluding weekends and public holidays). Since refunds cannot be made to
    bank cards, refunds will be made via transfer or EFT after obtaining the Passenger’s account details.
    The need to contact passengers to obtain necessary account information and to convey payment
    orders to banks affects the refund period. If your credit card/bank card/account used for payment
    has not been closed, your refund will be processed after the bank end-of-day report is received.
    5.9 Due to refunds of payments made by credit card, any financial damage, commission fees,
    etc., incurred and to be incurred by the Republic of Turkey or banks to ENtransfer will be deducted
    from the amount to be refunded to the Passenger.
    5.10 Rules to be followed during travels with Disobey Travel Agency:
  • No alcohol or drugs should be consumed during the journey inside the vehicle.
  • Avoid actions that may distract the driver.
  • Do not speak loudly inside the vehicle.
  • Do not disturb anyone, respecting the rights of other passengers.
  • Do not eat inside the vehicle during the journey.
  • Avoid actions that may endanger the safety of the journey.
  • Be aware of the obligation to wear seat belts during the journey and comply with it.
    5.11 The Passenger may not transfer and assign this Agreement and/or any rights and claims
    arising from and/or will arise from this Agreement to any person.
    5.12 This Agreement shall be subject to Turkish Law. In case of any disputes arising from the
    interpretation and application of this Agreement between the Parties, Istanbul Courts and
    Enforcement Offices shall have jurisdiction.
